Slightly confused... so you ended up with the payment for the lens plus the returned/damaged lens?

Have you ended up with both the lens and the full payment? If so that's a complete result as you could repair the lens and sell it again laugh  Though strictly it's not yours any more as you've received payment for it. If the original buyer has been given a complete refund from Ebay I guess it belongs to Ebay and they probably won't come after you for it.

Yes, I have the lens and the original payment. Throughout this whole episode, I've insisted it's eBay's property and I've been 'charging' them storage. I also told them that if it remained uncollected after 2nd December, I'd dispose of it as I see fit without reversion to them, includling payment. They've been offered the lens in settlement at least ttwelve times now and have not taken me up on the offer.

It's now got some damage to the tripod mount and internally the IS element is loose. It still works after a fashion on a body but nothing like it did prior to the buyer wrecking it. I'm sure it's repairable but I expect it'd cost a bit. They're not interested in taking delivery of it, so it's now my lens again. Oddly, I actually prefer it to the MkII I replaced it with..
